This  training course will introduce participants to transformative mediation theory, principles and practice skills at a basic, generic level, and will also address the specifics of family mediation practice (divorce and custody disputes, etc.) 

Topics addressed in the course include (among others):

  • The Experience of Conflict and the Mediator’s Role
  • Transformative Mediation Practices
  • Underlying Premises/Foundations of Practice
  • Understanding Parties’ Conflict Patterns and Process Dynamics
  • Effective Mediator Responses and Interactive Strategies
  • Creating the Context and Building the Process
  • Decision Making in Divorce Cases: Parenting and Finances
  • Integration of Mediation with the Legal Process
  • Working with parties with high conflict behaviors
  • Domestic Violence: Implication for Mediation Practice
  • Difficult Questions: Power and Fairness
  • Ethical and practice Standards

Through their work in the course, participants will gain a basic familiarity with the transformative theory and skills needed for mediation practice – skills which are also of great value in many areas of work and personal life.

Jody Miller is the executive director of the Mediation Center of Dutchess County, having worked closely with courts and the community to develop and provide mediation and conflict resolution training programs over her more than 20 years in the alternative dispute resolution field.  During her tenure and in partnership with the domestic violence community, Jody and her team created the award winning Domestic Violence and Mediation Safety Project.



Jody is an adjunct professor of mediation at the Maurice A. Deane School of Law at Hofstra University and is a Fellow of the Institute for the Study of Conflict Transformation.  She is a certified trainer through the New York State Unified Court System’s Office of Alternative Dispute Resolution Programs (ADR) and in July, 2013, earned Part 146 (court rule) approval for Initial mediation training.  She serves as an appointed member of the Mediation Ethics Advisory Committee.  She is the author of the chapter, “Choosing to Change: Transitioning to the Transformative Model in a Community Mediation Center,” in the publication, Transformative Mediation:  A Sourcebook: Resources for Conflict Intervention Practitioners and Programs, Association for Conflict Resolution/Institute for the Study of Conflict Transformation, 2010 as well as the recent article, “Mediating Commercial Cases in U. S. Municipal Courts:  A Case for Transformative Mediation,” Opinio Juris in Comparatione (Studies in Comparative and National Law), August 6, 2012. Lider-Lab, Scuole Superiore Sant’Anna, Pisa, Italy.  In 2013, with the Institute for the Study of Conflict Transformation, she created a video of a transformative commercial mediation that includes parties who are represented by their attorneys. She has been a presenter at conferences throughout the United States, as well as in Italy and China.

Peter Miller is a highly experienced transformative mediator in private practice in the New York metropolitan area.  He mediates primarily in the family and workplace arenas, although his experience also includes business and other disputes.  He has worked extensively for the United States Postal Service’s REDRESSTM Program, as well as for other government agencies with workplace mediation programs. In addition, Mr. Miller has extensive experience in community mediation cases. He serves often as a trainer on mediation, including in programs on transformative mediation skills offered by the Institute for the Study of Conflict Transformation.  He is an Adjunct Skills Professor at Hofstra Law School, and the Director of its Mediation Externship Program.
